Mobile Messaging Terms and Conditions

MOBILE MESSAGING TERMS AND CONDITIONS

405 Broadway Restaurant Group, LLC DBA The Goetchius House operates a mobile

messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (these “Mobile Messaging Terms”). The Program and our collection and use of your personal information is also subject to our Privacy Policy https://405broadway.com/privacy-policy. By enrolling, signing up, or otherwise agreeing to participate in the Program, you accept and agree to these Mobile

Messaging Terms, our Privacy Policy and our General Terms of use agreement.


1. Program Description: We may send promotional and transactional mobile messages in various formats through the Program. Promotional messages advertise and promote our products and services and may include [promotions, specials, other marketing offers, and abandoned checkout reminders]. Transactional messages relate to an existing or ongoing transaction and may include [order notifications and updates, appointment reminders, and other transaction-related information]. Mobile messages may be sent using an automated technology, including an autodialer, automated system, or automatic telephone dialing system. Message frequency will vary but will not exceed 4 messages per month]. You agree that we, our affiliates, and any third-party service providers may send you messages regarding the foregoing topics or any topic and that such messages and/or calls may be made or placed using different telephone numbers or short codes, except in connection with marketing purposes. We do not charge for mobile messages sent through the Program but you are responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply for short message service and multimedia message alerts.


2. User Opt-In: By providing your mobile phone number to us, you are voluntarily opting in to the Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal “Do Not Call” list. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at [insert email or other contact method].  Your participation in the Program does not require that you make any purchase from us and your participation in the Program is completely voluntary.


3. User Opt-Out and Support: You may opt-out of the Program at any time. If you wish to

opt-out of the Program and stop receiving mobile messages from us, or you no longer agree to these Mobile Messaging Terms, reply STOP, QUIT, CANCEL, OPT-OUT, and/or

UNSUBSCRIBE to the mobile number the message is sent from. You may continue to

receive text messages for a short period while we process your request and you may

receive a one-time opt-out confirmation message. You understand and agree that the

foregoing is the only reasonable method of opting out. If you want to join the Program again, just sign up as you did the first time, and we will start sending messages to you again. For support, reply HELP to any mobile message from us.  Our mobile messaging platform may not recognize requests that modify the foregoing commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these Mobile Messaging Terms. We may also change the telephone number or short code we use to operate the Program and we will notify you of any such change. You acknowledge that any requests sent to a telephone number or short code that has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number or short code that has been changed.


4. Disclaimer of Warranty and Liability: The Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program.


5. Modifications: We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Messaging Terms at any time. Any such modification will take effect when it is posted to our website. You agree to review these Mobile Messaging Terms periodically to ensure that you are aware of any modifications. Your continued participation in the Program will constitute your acceptance of those modifications.

House Policies and Rules

  

Guest Count for Events or Use of Space

Final Guest Count, not subject to reduction, is due seven (7) days prior to the event date. Any additional guest after the stated period is subject to extra charges as may be imposed by 405 Broadway. 405 Broadway Restaurant Group retains the right to charge additional for facility services for the amount of guests over the expected number declared by the client for use of space on this proposal. The extra charge will be calculated as a percentage of the grand total, considering the estimated cost per guest of this event. 


Minimum Attendance

If the final guest count is lower than the Guest Count, 405 Broadway reserves the right to cancel the event. If client insists on having the event with less than the minimum number of guests specified in this agreement, 405 Broadway will evaluate the matter at its own discretion, but the minimum charge will be based on the final Guest count provided 7 days prior to the event.


Entertainment

All outside entertainment booked by the client to perform during events scheduled at the restaurant must be pre-approved in writing by the restaurant management. All music performers must be associated with BMI (Broadcast Music, Inc.) or ASCAP (American Society of Composers, Authors, and Publishers) and SESAC (Society of European Stage Authors and Composers) to perform at 405 Broadway. Additionally, 405 Broadway Restaurant Group retains the right to limit the volume levels of performers and musicians booked by the client during the event to prevent disruption of other guests and patrons.


Property Utilization

The use of the property spaces provided in writing to patrons. No other utilization of the property's spaces is allowed if not indicated in writing and specified beforehand and agreed with 405 Broadway. The right to use the property space indicated is valid during the hours specified on this proposal. If the event surpasses the time indicated here, an "over hours fee" will be charged. If the client needs time before the event to set-up decorations, this shall be discussed and approved in writing beforehand with 405 Broadway.


Layout and Furniture Arrangement

The allowed use of the property is provided and approved in writing.  A room setup fee may be charged to adjust the existing tables and chairs to meet the guest count and type of service. Any specific layout request must be approved in writing prior to the proposal signing and it will be evaluated by 405 Broadway.


Decorations

All decorative items shall be discussed beforehand between the client and 405 Broadway. Guest will provide images, descriptions and dimensions of any decoration in advance and must be pre-approved in writing by 405 Broadway prior to being brought on the premises. Should an outside decorator be involved, a business license and proof of insurance must be provided in advance. 405 Broadway Restaurant Group reserves the right to forbid and prevent the use of certain decorative items that; go against company policy; or might be offensive to anyone; or might damage the property or injure staff or guests. At no time will guests be allowed to use tape, glue, nails or other means of mechanical hardware on the property for decorations.  405 Broadway Restaurant Group forbids the use of open flame, wax, glitter or confetti on the property. Any fee standing decorations require a full description and pre-approval for use and guest will respect the placement of such items to assure compliance with fire and safety code. Guest is responsible for removal and disposal of any decorations brought on site. Guest shall not use the commercial dumpster on site for removal of decorations or objects and guest is responsible for removal of their own decorations. Should any decorations or objects be left on the property after a guest event, 405 Broadway is not responsible for the items. Further, should 405 Broadway need to remove, disassemble, store and/or dispose of any decorations or installations, a minimum fee of $500 shall apply with addition fees deemed fair and reasonable to return the property to the condition prior to the guest event.


Damage Waiver

Client agrees to be responsible for all damages to the building, equipment, fixtures, furniture, objects and property decorations indoors and outdoors. If any damage is caused by client, client’s guests, invitees, employees of the guest, contractors of the guest, vendors of the guest or any other person with any association or connection to the event, the client remains fully responsible for repair or replacement. Please note that many objects and features on the property are one of a kind and irreplaceable, so great caution should be taken to ensure no damage occurs.


Event Gratuity

Gratuity is elective and any proposal provided to a guest will provide a suggested gratuity. Clients may choose their own gratuity rate that is paid directly to the staff serving them. Gratuity is paid to staff, not kept by the establishment.


Security Deposit

A security deposit is required to reserve use of space on a certain date, time and location. This deposit is nonrefundable if the event is canceled less than 30 days prior to its set date. If canceled more than 30 days prior to the set date the deposit amount will be refunded to the client. The consideration of a security deposit shall be considered as a binding agreement for a future reservation, and guest agrees to comply with the House Rules and Policy as well as the conditions that may be provided subsequently through a proposal.


Video Capture

The entire property, inside and out, contains extensive video and audio surveillance.  The public notice of use of video surveillance is marked at the property entrance. Should video archives be required to be retrieved to assure the safety and responsible actions of guests, a fee of $250 per hour shall be assessed to the guest for recovery of content to review activities related to their event.


Use of Images at The Goetchius House

The Goetchius House is a private property and private residence, neither still photos nor motion videos are permitted nor shall be used without explicit written consent for use prior to use. Any use of content on social media is strictly prohibited and should be removed until written consent is obtained by 405 Broadway. Audio content may be subject to music licenses and playing of this content may subject the individual positing such content to music license violations. Guests need to be aware that statutory copyright infringement damages may range from $750 to $30,000 per song with BMI, SESAC and ASCAP with willful infringement escalating to $150,000 per song plus legal fees.
